Terms and Conditions.
Welcome to Human Keystone with Michael Wachter. I lead Services such as private, and group classes in person and online, as well as retreats, days, etc. This website is owned and operated by Michael Wachter. These terms and conditions (collectively, the “Terms” or “Agreement”) define your rights and obligations related to this website, attendance of classes or booking of services. By accessing this website you approve that you have read, understood and agree to be bound by these Terms.
Agreement
By using my services, you agree to be bound by the terms of this Agreement. By entering into this Agreement, you are confirming you are an adult of legal age, you understand and accept this Agreement, and you are legally and financially responsible for all actions using or accessing my services. If you are under the legal age of majority, your parent or legal guardian must consent to this Agreement. If you (or your parent or legal guardian) do not or cannot agree to the terms of this Agreement, you may not use my services.
This Agreement is a legal agreement between you and I, and it describes the terms and conditions for using the Services. In addition, by agreeing to this Agreement, you are also expressly agreeing and acknowledging that various third-parties may be exercising some of our rights on our behalf under the Agreement. By accepting and agreeing to this Agreement, you are also agreeing to my Privacy Policy, which is expressly incorporated in full into this Agreement. My Privacy Policy describes the types of data I collect from you and your devices, how I use your data, and the legal bases I have to process your data.
I may modify these Terms at any time. Please review any modified Terms before you continue using my services. If you continue to use my services, you are bound by the modified Terms. If you do not agree to be bound by the modified Terms, then you may not use my services. By using any of my services, you represent that you are at least 18 years old, and that all information you submit is correct
The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Michael Wachter. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.
You agree to indemnify and hold Michael Wachter harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.
To the maximum extent permitted by applicable law, in no event shall Michael Wachter, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.
To the maximum extent permitted by applicable law, Michael Wachter assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of Michael's service; and (iii) any unauthorised access to or use of our secure servers and/or any and all personal information stored therein.
These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of the United Kingdom, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in London, UK. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.
Terms
Booking Policy
Private and group classes can be booked online, on phone or in person. Some group classes do not require booking. I ask that you arrive at the class 5/10 minutes before it begins. If you are not present 5 minutes before your class and there is a waitlist your spot may be offered to another Person.
Late cancellation/No show policy
If you are unable to attend a class/course/workshop or event after you purchased a ticket you can transfer the ticket to another person, however it is not possible to refund the ticket once purchased.
Age Restrictions:
Anyone under the age of 18 is able to participate in most classes, workshops and retreats as long as their responsible adult is present also.
All people under the age of 18 years are the responsibility of the accompanying adult when at class.
Operating hours and schedule:
Michael Wachter reserves the right to vary the class schedule and operating hours. These changes to the schedule will be published on the timetable online, or with you personally.
Cancellation:
In the event that I cancel a Retreat/Workshop/Class I will refund you all deposits and payments you have paid. I cannot however compensate you for airfare, travel or other costs incurred. In the unlikely event that I or you must cancel a Retreat/Class or booking of, due to force majeure (including but not limited to; weather, disease epidemics, natural disaster or political upheaval) I cannot guarantee a refund. To cover these risks, I highly recommend that you purchase travel insurance if traveling.
Cancellation of classes or sessions due to unforeseen circumstances may occur. Michael Wachter reserves the right to cancel classes or sessions due to unforeseen circumstances that may occur. Michael Wachter reserves the right, at his discretion, to change or modify the schedule, move classes on-line or offer usage of a different studio/location.
Personal Belongings:
Personal belongings are brought into class at the individuals risk and Michael Wachter does not accept liability for any loss or damage whatsoever to such items.
Phones sounds must be completely silenced (sound and vibration off), or on airplane mode upon entry to class.
Fitness and Health:
Before beginning a Breathwork practice or any other class please consult your doctor, especially if you have pre-existing disease, illness or injury. Michael Wachter reserves the right to refuse access to any individual if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by practicing Breathwork or attending any other class.
Individuals with the following conditions should not attend class without a written letter from their doctor: low/high blood pressure and cardiac irregularities. If there is any doubt, the individual should consult his/her doctor. Individuals must notify Michael Wachter of any circumstances affecting their health which may be exacerbated through attending a class.
Liability:
Michael Wachter cannot be held responsible for any service or class not being available for whatever reason. Michael Wachter reserves the right to make alterations to the types of services provided, without notice and in its absolute discretion and Michael shall not be liable for any loss occasioned by such alterations except insofar as loss is by law, incapable of exclusion.
It is your responsibility to ensure that you are capable of undergoing a routine of exercises provided by any programme that they follow or class that they attend. You accept the risk of injury from performing exercises and are advised to consult your doctor prior to beginning any programme or class. India Terry accepts no liability for loss or damage to property or injury of individuals attending class such as loss, damage, or injury is by law incapable of exclusion.
